Terms and Conditions



WORLDCARD POINTS ("WCP")
  1. Subject to prevailing terms and conditions that may be imposed by the Program's participating merchants (including but not limited to CI) ("Merchants") WCP (Collectively referred to the "Points") and/or discounts, privileges promotions ("Benefits") are awarded to the Cardholder when the Card is presented for all approved transactions (whether settled by cash, credit card or such manner acceptable by Merchants) at participating outlets. The basis upon which the Cardholder may be permitted to accumulate the Points shall be determined by the Merchants at their sole and absolute discretions and may be changed from time to time without prior notice and the Cardholder are not entitled to question, request or demand the CI or Operator to disclose or explain the methods determining or other matter relating to the Points for whatever purposes.

  2. The Card will not be accepted if the Card (a) has expired; (b) is invalid, lost or stolen; (c) is damaged; (d) does not carry the Cardholder's signature; (e) had been altered, defaced, re-printed or re-embossed; or (f) such other irregularities on the face of the Card.

  3. WCP accumulated under different type of WC owned by the same Cardholder cannot be combined without the Operator's prior approval.

  4. Points and Benefits are not transferable, not exchangeable for cash and must be used by the Cardholder within such validity period as determined from time to time.

  5. Any points not utilized after the expiry period of the Points will automatically become invalid and obsolete and be cancelled without prior notice. Thereafter, the Cardholder shall have no further claims whatsoever in respect of the said points.

  6. Cardholder with sufficient points may redeem rewards made available by the CI, the Merchants or the Operator ("Rewards") subject to the terms and conditions determined from time to time at the absolute discretion of the CI, the Merchants or the Operator (including but not limited to presenting the Card a signing any relevant forms and the production of any identification documents.)

  7. No Points will be accorded for all redemption transactions.

  8. The redemption orders once accepted by the CI, the Merchants or the Operator cannot be revoked, amended, cancelled, returned or exchanged for others items.

  9. All Rewards are subject to availability and the CI. The Merchants and the Operator reserve their right to replace any item of approximately the equivalent value without prior notice.

  10. Generally the terms and conditions upon which the Points may be exchanged for Rewards, including the number of Points required to be exchanged for any particular reward, and the procedures involved in the redemption shall be determined by the CI and Operator from time to time at their sole and absolute discretion and may be amended or changed by the CI and the Operator from time to time without prior notice. The CI and the Operator may at its absolute discretion:-
    1. Restrict the quantity of a particular Reward that a Cardholder may exchange for Points.
    2. Classify Cardholders into different categories according to their points accumulated or according to other various criteria stipulated by the CI and the Operator form time to time.
    3. Offer different rewards and benefits for redemption by different categories of Cardholders.
LOST / STOLEN / DAMAGED CARD
  1. The Cardholders shall all immediately inform the CI once their Card are discovered to be lost, stolen or damaged and followed up with written confirmation within 7 days from the notification date.

  2. Charged for replacement of the lost, stolen or damaged Card shall be of such sum or such number of the Points that may be determined by the CI at the material time. The CI reserves the right to reject the Cardholder's request for replacement of any lost or stolen Card.

  3. Upon receipt of the CI's notification, the Operator will invalidate the lost, stolen or damaged card within reasonable time without further notice to the Cardholders. The CI and the Operator disclaim their liabilities on any losses or damages (either directly or indirectly) that may be suffered by the Cardholders arising from the invalidation of the Card or any delay in canceling Card.
PROMOTION MATERIALS
  1. The CI and the Operator reserve the right to mail to the Cardholders catalogues or other promotional literature relating to the Program or such other projects, campaigns or promotions that may be carried out by the CI or the Operator or their respective holding companies, subsidiaries, associates or related companies.

  2. The CI and Operator shall not be liable for any losses or damages of whatsoever nature that may be suffered by the Cardholder arising whether directly or indirectly from the delay or failure to receive any catalogues, promotion materials or information from the CI and the Operator.
TERMINATION
  1. The Cardholder may terminate the use of the Card at any time by notifying the CI in writing accompanied by the return of the Card and the Card should be cut into two before dispatch.

  2. The CI may at its sole and absolute discretion terminate, suspend or cancel the Card at any time with or without prior notice and with or without cause. Upon such termination or suspension or cancellation. The Cardholder shall immediately return the Card to the CI upon request and the Card should be cut into two before dispatch.

  3. Upon the termination, cancellation or suspension of the Card for any reason, all Points and Benefits which may be available to the Cardholder shall be deemed to be automatically cancelled with immediate effect unless a grace period is granted to the Cardholder to utilize such Points. Any unutilized Points after expiration of the grace period will be cancelled without further notice.
OTHERS
  1. The CI reserves the right to amend or supplement any or all of these T&C from time to time at its sole and absolute discretion with or without notice to the Cardholder as the CI may deem fit. The Cardholder agrees to be bound by such amendment and supplement unless the Card is terminated in accordance with these T&C.

  2. In no event shall the CI and the Operator be liable to any cardholder or any third party for any loss or injury or any special, direct, indirect, incidental, exemplary or consequential losses or damages whatsoever or howsoever caused under any cause of action arising directly or indirectly in connection with the program or the use of the Card, including but not limited to the following:
    1. Loss of use (whether in action of contract, negligence or other tortuous action) arising out of or in connection with the Cardholder's use of the services or goods provided by the Merchants; or
    2. The Cardholder's inability to use or procure such services or goods; or
    3. The suspension, termination or cancellation of the Card; or
    4. Any delay in processing the applicant for the Card; or
    5. Any delay in replacing the Card; or
    6. Any failure of a Cardholder to notify the Merchants that he/she is a holder of the Card; or
    7. Unavailability of Benefits or Rewards for whatever reasons; or
    8. Any losses or damages that may be suffered by the Cardholder in relation to any changes, amendments or variations to these T&C or terms and conditions set by Merchants at their participating outlets; or
    9. All or any losses or damages of whatsoever nature arising from aforesaid whether directly or indirectly.

    If the CI and the Operator are found liable by court of competent jurisdiction, the liabilities of the CI and the Operator to the Cardholder for any cause whatsoever and regardless of the form of action (whether such liabilities arise from any claim based on breach or repudiation of contract, warranty, tort (including negligence) or otherwise shall, to the extent permitted by law, be limited to restoring or according any Points and/or Benefits that have been mistakenly omitted in the Card's account due to gross negligence of the CI and the Operator (as the case may be).

  3. Whilst all reasonable care is taken to ensure that information, publications, advertisements and promotional materials supplied or provided in connection with the Card is true and accurate, the CI and the Operator shall not be held liable for any direct or indirect consequences arising from errors or omissions (including negligence) in such information, publications, advertisements and promotional materials, whether written or oral.
